An Analysis Of The Transition From Litigation To ADR

ABSTRACT

ADR refers to various practices of settling disputes without reaching the courts. In today’s world there is a rapid increase in disputes between the parties. Litigation provides a solution and resolves all the cases, but it takes a very long time to do so. In some cases, people belonging to the low income category find it difficult in paying the expenses in approaching courts. ADR provides solutions to the problems faced by people caused due to litigation. It helps to resolve the cases in a fast way and in a cheaper way. It helps to provide a satisfactory solution by taking into consideration the interest of both the parties.

This article focuses on challenges faced by people due to judicial proceedings and also about the challenges faced after the effect of Covid-19. It also explains about the process of ADR and helps us to know in what ways it is better compared to traditional litigation and also advantages of ODR after Covid-19.
