An Analysis On The Child Sexual Abuse Under The POCSO Act

ABSTRACT


Child abuse is a harm to, or neglect of, a child by another person, whether adult or child. Child abuse is been found in all cultural, ethnic, and income groups. There is no standard and proper definition of ‘child sexual abuse’. A form of child abuse known as child sexual abuse, known as child molestation, happens when an adult or older adolescent exploits a kid for sexual stimulation. A problem that came into light is rape, sexual abuse, and sexual harassment are worldwide issues of gender violence especially child abuse. The POCSO Act was enacted on 14th November and was again revised on August 6, 2019 to make it more effective in dealing with the problems of child sexual abuse in the country, and went into force on August 16, 2019. The issue of child sexual abuse is gradually becoming a recognized issue, and for this reason, this paper will focus much on sexual abuse against minor children: the laws, victims, and perpetrators. An analysis of the aspects and ideas of Indian culture that make this issue, particularly difficult to understand and solve. This research paper discusses how the POCSO Act influences the sexual rights of the adolescents and the need for evaluating the concept of the consensual sexual act from a legal perspective in India.
