An Overview Of Delimitation And The Problems Arising Out Of It

Aditya Roy, B.A. LL.B., St. Xaviers University, Kolkata

ABSTRACT

Delimitation, remains arguably ‘a function of the greatest constitutional importance’ which professes the core democratic principle of ‘one person, one vote, one value’. The territorial boundaries we are restricted to dictate our beliefs, culture, demographic and ideologies- these territorial ideologies are represented in the Acts of the State by the elected representatives. But this image of a representative form of Governance has been blurred by decades of negligence and trivialising. In this paper we emphasise on the necessity of creating a balance between state policy and democratic principles while exploring the subject of Article 82 and its historical background also while analysing the impact of the Constitutional Freeze and the problems arising out of it and what the future holds for the Indian Political Structure.
