Analysis Of Doctrine Of Part Performance In Property Transactions

ABSTRACT


The “doctrine of part performance” plays an important role in the contracts related to the sale of the immoveable property transactions that comes under TPA. This study throws the light upon the comprehensive analysis of the theory of part performance analyzing its significance in today’s property transactions. This study also examines history and the position of part performance under both English and Indian law.


This study also transverse the provisions related to the doctrine as well as it also covers the objectives, essential components related to the doctrine including its exceptions. In addition to this study, it also analysis the challenges that are faced while the transfer of the immoveable property including the remedies for the same and following up with the suggestions that can make this doctrine more applicable.
