ABSTRACT

The tribal communities who live near forests and away from main cities. They are inhabitants who was living in forest from time immemorial. The livelihood, cultural and spiritual, food usage of forest land for their survival all are dependent on forest. There is a constant struggle to safeguard rights of tribal people from non-tribal people. The State has a duty to safeguard their right to livelihood. Government has been initiating butter coated measures but there still exists inconsistency. It is not only the case in India but also in International arenas. Many countries are facing the dispute of eviction of forest dwellers from forest lands by corporates and sometimes Government in the name of public good. Moreover, the forest dwellers rights are seemed to be negated and redefined as rights to settlement and rehabilitation. In the name of development of the country the forest lands and resources are grabbed from the forest dwellers. Their livelihood, agriculture, farms, environment, trees, valuable medicinal plants are destroyed. The paper focuses on why there is an eviction of forest dwellers from forest for unreasonable reasons, analysis on popular case Vedanta and inconsistencies in forest rights act for the protection of forest dwellers.
