Article Review – “Bailment: Automobile Parking Lots: Limitation Of Liability”

ABSTRACT

This paper is an article review of an article titled “Bailments: Automobile Parking Lots: Limitation of Liability”1 by Roy C Packler. The primary focus of this article is on the contract of Bailment and the limitation of the liability clause in the parking tickets. This paper will consist of an analysis of whether or not a relationship of bailment exists between the owner of the commercial establishment that is providing the parking space and the owner of the car that is being parked. If there is a relationship of Bailment then how liable is the owner of the establishment if something were to happen to the car. This paper also looks at understanding the validity of the limitation of liability clause mentioned in the parking ticket. It will look at case laws and statutory authorities to understand these concepts.
