Artificial Intelligence As A Fashion Designer: Who Owns The Rights?

ABSTRACT


Artificial Intelligence (AI) has transformed numerous industries, and the fashion sector is no exception. Advanced AI systems can now generate clothing designs, predict fashion trends, create digital garments, and assist designers in producing innovative collections. As AI increasingly participates in the creative process, a significant legal question emerges: who owns the intellectual property rights in AI-generated fashion designs? Traditional copyright law is based on the assumption that creativity originates from human authors. However, AI-generated designs challenge this premise because machines can independently produce original patterns, garments, and visual concepts with minimal human intervention. This article examines the role of AI in fashion design, the legal framework governing ownership of AI-generated creations, and the competing claims of designers, developers, companies, and AI systems themselves. It further analyzes copyright, patent, trademark, and design protection issues arising from AI- generated fashion products. The article concludes that existing intellectual property laws are not fully equipped to address the challenges posed by AI creativity and that legal reforms are necessary to balance innovation, investment, and protection of human creativity in the fashion industry.
