ABSTRACT
The integration of artificial intelligence (AI) in predictive policymaking is altering governance paradigms around the world, particularly in developing democracies such as India. AI's ability to evaluate large datasets and predict policy consequences has led to its use in a variety of industries, including healthcare, criminal justice, urban planning, and welfare distribution. However, the rise of algorithmic governance presents complicated legal and ethical issues. This research critically investigates the ramifications of AI- powered predictive policy in the Indian legal framework and democratic context. This study shows the shortcomings in India's existing legal architecture by delving deeply into privacy rights, algorithmic accountability, discrimination, and intellectual property issues. The paper also looks into ethical issues like informed consent, transparency, human autonomy, and civil society participation. Drawing on global case studies and regulatory models, the paper underlines the need to strike a balance between innovation and constitutional safeguards. The report calls for substantial legislative reforms, institutional monitoring, and participatory policy frameworks that are consistent with India's commitment to democracy and social justice. As India seeks to establish itself as a global AI hub, it must guarantee that predictive governance technologies support rather than hinder human rights and public accountability. This study adds to the ongoing debate by proposing a rights-based approach to AI legislation in India, founded on legal logic and ethical responsibility.
