Beyond Domestic Duties: Recognising Property Rights Of Homemakers In India

ABSTRACT


This research paper focuses on the ‘property rights of a homemaker or a housewife in India’. women in India have always been considered subordinates to their husbands, which has made them both socially and financially weak. The society has built a boundary called patriarchy around women in India which has forced them to not to step bound that boundary for ages and thus has forced women to accept that bondage.


Majority of the population of women in India are homemakers who are involved in the daily household chores for their entire lives. Homemaking is not a professional job, it involves no monetary gain, thus is not an economic activity. In other words, a homemaker is responsible for maintaining the property of her husband and to raise their children for her entire lifetime.


In this research paper the readers will get an insight that the housewives have the right to the equal share in the property of their husbands which they maintain for their lifetimes. The recent Madras High Court judgement has stated that the housewives have equal right to the share of the property of her husband. Also, after the implementation of such judgement the perspective of the society towards women will show a significant change.
