Can Artificial Intelligence Claim Invention? An Abridgement On Artificial Intelligence And Patent

ABSTRACT


There is always a matter to hit your brain continuously and effectively, that generates as well as work for us without stopping and generally this conception is eventually being identified as Artificial intelligence. These are basically man- made robot or artificials that are primarily incorporated to work, similar to human intelligence, in a given situation. Based on a generalised approach, probably having a reasonable decision making and finding solution to a problem, whose production is based on algorithms or formula’s.


This study is primarily focused on Artificial intelligence that works with primarily humans acting as an aid and its basic way of functionality, that ends up in an enigmatic environment.

Added, a new horizon of idea aroused, that have hit the crux is with regards to such Artificially Intelligent machines, can be patented or not. Today, we are challenged by this idea where it is a big question in addition to the exponential rise of plethora of new applications for registration of a patent by its inventor, that if such machines could be treated as equal to individuals, claiming inventions.


Thus, to look into an answer for the above scenario, the paper also tries to discuss about the principality of the Artificial intelligence inventorship that further includes in it about the question of law, whether this conception of Artificial Intelligence as an inventor is jurisdictional and aiming to understand who needs to be an inventor under the patent law. Finally, this study also looks into the idea that how we can dichotomize Artificial Intelligence system from the humans.
