Kashvi Jindal, Vivekananda Institute of Professional Studies, Delhi

INTRODUCTION

In India, the concept of live-in is starting to gain importance. It has been recognised in various judicial pronouncements. The Constitution of India guarantees the Right to Life under Article 21. This article allows two individuals who are above the age of 18 years to reside together as a live-in couple.2 In the case of Lata Singh vs State of Uttar Pradesh3, the couple was provided with protection from their family member. Therefore, Live-In relationships are there to understand and see compatibility. However, Live-In relationships are not socially accepted in totality. The children born out of live-in are considered to be immoral and against the cultures of the society. Despite all these controversies, it is important to give status to children born out of live-in relationships. It is important to consider and lay down a clear answer to this question. It is important to know whether the child born in a live-in relationship is legitimate or illegitimate and what is the status of a child if the relationship is for a longer period of time. This case law will help in understanding this question.
