Case Comment: Jeetubha Khansangji Jadeja Vs Kutchh District Panchayat

ABSTRACT

The following is a case commentary on Jeetubha Khansangji Jadeja v. Kutchh District Panchayat, decided on the 23rd of September 2022 by the Hon’ble Supreme Court. The case deals with the unfair dismissal of an employee working under the Kutchh District Panchayat as a watchman. The watchman had worked for the employer, Kutchh District Panchayat for 10 years, after which his employment was terminated without any notice or cause. The employer failed to follow the procedure for dismissal of an employee laid down by the Industrial Dispute Act of 1947. The judgment in this case was delivered by the Supreme Court after the case went on a Special Leave Petition under Article 129, after a prolonged delay of more than 10 years, where there was no remedy for the aggrieved party, the watchman.
