THE RECENT judgment passed by the Hon’ble Supreme Court of India1 has spurred up the debate on the fundamental right of freedom of expression. By emphasizing the difference between the government and the country, it supports the citizens' right to question the state.
According to Article 19 of the Universal Declaration of Human Right;
The freedom of expression is defined as everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.
The Constitution of India provides the right to freedom, given in article 19 with the view of guaranteeing individual rights that were considered vital by the framers of the constitution. The right to freedom in Article 19 guarantees the freedom of speech and expression, as one of its six freedoms.
