1. INTRODUCTION

Marriage was regarded as a sacrament rather than a transaction under Hindu law. As a result, the notion of terminating a marriage by mutual consent was foreign to Hindu law. However, the Hindu Marriage Act, 1955 was amended in 1976, and the notion of mutual divorce was adopted by Parliament. The major goal of this clause was to keep the parties out of misery if the marriage had irreparably broken down and there was no way for them to live together as husband and wife.
