ABSTRACT

This article examines marriage in detail and provides a detailed analysis of it. Marriage should be safeguarded by legislation as it is a holy institution in society. However, this must not be misused to the point where marriage becomes the cause of harm of any type, including physical, mental, and legal harm. As a result, when a marriage is solemnized, if one spouse leaves the other's company for a justifiable reason, the victim has the right to ask The Honourable Courts for the restoration of their legal rights. The court will order the restitution of legal rights if it determines that the opposing relative has wronged the petitioner by withdrawing from the obligations of the marriage relationship. This case is significant because it involves the restitution of legal rights as a remedy.
