Introduction

On 16th of July, 2021, a two-judge bench comprising of Justice RF Nariman and Justice BR Gavai delivered an important judgement regarding the conducting of the Kanwar Yatra with the physical attendance of the devotees. Through the order, the Hon’ble Court observed that when faced with a conflict between religious rights and the right to life and health of the citizens, the right to religion shall be subservient to the right to life as the right to life is paramount to every person irrespective of their religion.
