INTRODUCTION AND RELEVANCE
The Indian patent regime has over the years has tried to maintain a perfect balance between protecting the rights of inventors at the same time while at the same time keeping in mind the interest of public at the large. The legislature has enacted laws that help it fulfill its role as a welfare state while at the same time fulfill its international obligations under the TRIPS agreement. Judiciary to on its part, has interpreted these laws in such a manner that they fulfill their parliamentary objective. One such case where the courts have tried to maintain such balance is in Novartis v. Union of India.
