Challenge Of Delegated Legislation In The Context Of Rule Of Law

ABSTRACT

A crucial issue in constitutional law and government is how to deal with the problem of delegated legislation in the context of the rule of law. Delegated legislation is a term used to describe laws that are enacted by a body other than the main legislative body, which is normally the parliament or congress, but which is however given the ability to do so by the main legislation, like Government ministers, departments, and other entities.

Delegated legislation poses various issues connected to the rule of law, even if it might be a useful tool to address complex and technical legal issues. All people and institutions, including the government, are said to be subject to and responsible for the law according to the fundamental premise of the rule of law.
