Challenges In Cyber Security In India: Domain Name Disputes And Cybersquatting

Dr Tanveer Kaur & Dr Gagandeep Kaur, University of Petroleum and Energy Studies

ABSTRACT

Conflicts over domain names primarily emerge from abusive domain name registrations and trademark infringement, such as cybersquatting, which is the insertion of a trademark owner's mark into a domain name that is not the owner's. As a result, the domain might be utilized to send users to an unrelated business or website. The basic reason behind these threats is the desire to be popular quickly. Cyber security threats in this domain have been increasing at a high rapid pace and needs to be regulated very seriously. There is presently no explicit statute legislation in India that addresses dispute resolution in cybersquatting or other domain name issues. The present paper seeks to provide an overview of regulations on cybersquatting, relevant cases and its impact in India.
