ABSTRACT


As the 21st century witnesses unprecedented advancements in technology era, the intersection of individual liberties and digital innovations have become a major point of discussion. This intersection necessitated a critical examination into the jurisprudential aspects of right to privacy, prompting an exploration of its evolution in the contemporary digital world. This research paper aims to shed light on the intricate balance between individual rights and imperatives of technological advancement through a careful examination of historical developments, jurisprudential shifts and contemporary challenges. Examining jurisprudential foundations of right to privacy becomes crucial for legal scholars and practitioners to apply the established principles to the newer dynamics of ever evolving digital age.


To begin with, the paper engages with the jurisprudential analysis, delving into the constitutional debates surrounding the right to privacy and further developments that led to the current position of privacy laws in the rapidly evolving digital landscape. The paper then evaluates the current state of privacy laws in the ever-evolving digital landscape, by examining how the legislative frameworks have adapted to address the emerging problems while upholding individuals’ right to privacy. The paper, by discussing landmark judgements, scholarly interpretations and legislative frameworks, examines the dynamic character of privacy rights and the challenges posed by the technological advancements.
