ABSTRACT


The topic chosen for the research paper is Legal Traditions and Western Legal Traditions World. The research question chosen by me is How are criminal liability of juveniles different in India and the United States? The main overview of the paper is the conduct a comparative study of criminal liability of juveniles in India and the United States.


The main objective of this research paper is to explore the different criminal liability enforced upon juveniles in India and the United States. The main focus of this paper will be to compare and analyze the differences in the Indian juvenile laws to the juvenile laws in Florida. In the US, many states have their own designated laws regarding the juvenile laws. Whereas, in India, the laws governing the criminal liability of juveniles are Indian Penal Code, 1860 (IPC) and the Juvenile Justice Act, 2015 (JJ Act). My paper will be divided into three parts: i) explaining the laws separately; ii) discussing and analyzing the differences and iii) changes that India or US can adapt. My paper uses the theory of comparative law as a method to compare and improve the juvenile criminal liability laws.


The methodology used for this research paper is to use Indian statutes and US statute to analyze the laws. I will primarily base my arguments on Indian Penal Code and Juvenile Justice Act to discuss the Indian laws and Florida Statutes. Apart from that, I will be referring to different government officiated websites, articles, and case laws to build my case.
