ABSTRACT

This article first of all talks about the administration of Wakf in India in this present situation, powers and functions of the Central Wakf Council and State Wakf Boards in India as the author considers the Wakf council and boards to be administrative authorities which has exclusive powers vested within. Central Wakf Council and State Wakf Boards are widely established and effectively functioning in this contemporary period. The Central Wakf Council and the State Wakf Boards are governed by the parent Act called the Wakf Act, 1995.

Then, this study mainly analyses and explains all the things happened in the case of Telangana State Waqf Board v. Mohamed Muzafar1 briefly and comprehensively so that the readers understand the concept and powers of Wakf Boards clearly. That case's decision is a landmark judgement given by the Supreme Court while deciding the jurisdiction of wakf boards or tribunals to decide whether a property is wakf owned or not. This article hopefully will be useful for those who want to have a clarity towards the jurisdiction of wakf boards to decide matters relating to wakf properties and those who are engaged in the field of law and of administration.
