Compulsory Licensing And Shortage Of Drugs During Covid-19: How Can Compulsory Licensing Help In Reducing The Scarcity Of Covid Drugs And Vaccines?

INTRODUCTION

Covid pandemic has adversely affected the lives of people throughout the world. Glimpses of this apocalypse can be clearly seen during the second wave of pandemic in India. During these unprecedented times, the global drug supply got severely affected, alleviating the effect of the pandemic and shortage of covid drugs and equipment was the major reason of making the effect devastating. The lack of of oxygen has largely affected the lives of people, throughout India.

WHAT IS COMPULSORY LICENSING:-

WTO have to provide patent protection for any invention, whether a product (such as a medicine) or a process (such as a method of producing the chemical ingredients for a medicine), while allowing certain exceptions Article 27.1

Compulsory licensing is when a government allows someone else to produce the patented product or process without the consent of the patent owner. In current public discussion, this is usually associated with pharmaceuticals, but it could also apply to patents in any field.
