ABSTRACT


Gender identity, a fundamental aspect of self-perception, has historically been a contentious issue in legal frameworks around the world. In India, there have been significant shifts in the recognition and protection of gender identity in recent years, mainly due to judicial interventions and legislative changes. This research paper examines the constitutional recognition of gender identity in India, examining evolving legal perspectives, landmark court decisions, and legislative measures aimed at protecting the rights of transgender and gender non-conforming individuals.


Through a comprehensive analysis of relevant constitutional provisions, statutory provisions, and judicial pronouncements, this paper sheds light on the current legal situation surrounding gender identity in India, assesses the effectiveness of existing measures, and suggests recommendations for further legal reforms to ensure comprehensive protection and recognition of the right to gender identity.
