Constitutional Regulation Of Elections In India: Legal Validity Of Notifications Passed By The Delimitation Commission

ABSTRACT


In India, delimitation is a vitally important aspect for the country's democratic structure. The Election Commission defines 'delimitation' as "the act of establishing the boundaries of territorial constituencies in a country or province with a legislative body." Delimitation has been subject to political manipulation and, as a result, a freeze in certain regions, putting the pursuit of equitable representation on hold. The paper investigates the constitutional and legal validity of delimitation and Delimitation Commission set up by the Parliament under Article 327. The case study aims to discuss the legality of the notifications issued by the DC and whether it can be considered as ‘law’ passed by the parliament?
