Constitutional Safeguards Against Construction-Related Pollution And The Right To Breathe Clean Air

ABSTRACT

The construction sector is one of the major contributors to environmental pollution and risk. The environment and human life are interdependent. Human life cannot live without the earth's natural resources, including the air, water, and soil. Pollution is caused by on-site activities such as rock cutting, debris dumping, and site cleaning, all of which take place in arid environments and contribute to pollution. Diesel engines used on construction sites with small or no chimneys lead smoke directly into the environment and also cause noise pollution from machinery. No person "shall be deprived of his life or personal liberty unless in accordance with the method prescribed by law," According to Article 21, everyone has a fundamental right to life. A fundamental human right is to live in a safe environment that is free from disease and infection. The right to a healthy environment is part of the right to live with dignity. Everyone has a right to a healthy environment under Article 21 of the Constitution. This article gives a general overview of how the construction industry affects the environment and how it is protected by law under the Indian Constitution's provisions for environmental protection and pollution prevention.
