Constitutional Safeguards For Scheduled Tribes In India: An Analytical Study Of Rights, Protection And Social Justice

ABSTRACT
The constitutional safeguard provides the protection for scheduled areas and scheduled tribes in India with the particular focus on rights, welfare and protection of forest rights. These community suffered the backdrop and faced various discrimination in past decades. The constitutional as well as legal framework to dedicate the rights and protection for tribals are important to preserve the rights and protect the interest of the tribals. The constitution provides the dignity and participation in nation life which mentioned under part III of the constitution. It allows the equality, dignity, participation in political life and protect from the economic deprivation. The constitution further states the special power to tribal areas for the special administrative arrangement to protect the tribal areas within the territory of India. The fifth and sixth schedule provide distinctive administration power and arrangement to protect the tribal areas. The legislative measure relating to the forest rights and local self-governance strengthens community participation and resource protection. The article examines the role of constitutional institution in protecting tribal interest and promoting their socio-economic advancement. It highlights the proper implementation and awareness and community participation and institutional accountability. The study concludes that meaningful implementation of constitutional safeguards and rights is essential to achieve the substantive equality, promoting tribal identity and promoting inclusive social justice in India.
