Conversion And Hindu Law: Addressing The Societal Impact And Matrimonial Conflict At Play

ABSTRACT

Conceptually Law and society are intertwined, the impact of legislation on the society and understanding the sociological impact is of an utmost importance, The question of religious conversion is of an important consideration within the legislative ambit of Hindu law. This paperexamines the concept of religion within the scope of Article 25 of Indian constitution and attemptsto answer through relevant judgments whether the right to propagate incorporates within its framework the right to convert. In the second part, the impact of religious conversion on the community at large is addressed and the sociological aspect of conversion and its eventuality hasan important bearing on the legal aspect at play. The final part of the paper, attempts to analyze theimpact of conversion on marriage and subsequently explores the inter personal conflict in law onthe question of conversion. The question of implementation of a uniform civil and its importancein the light of irreconcilability between the general secular law and person law is explored.
