ABSTRACT


The rapid expansion of user-generated content (UGC) in the digital age has intensified the need for robust copyright enforcement mechanisms. While copyright law aims to protect intellectual property, its application to UGC raises significant legal and technological challenges. This research explores the complexities of copyright regulation in the context of UGC, analyzing the role of digital platforms, legal frameworks, and technological advancements in managing copyright infringement. By examining common infringement scenarios and case studies, the study highlights the growing tensions between copyright holders, content creators, and online platforms.


Technological solutions such as AI-driven automated content detection and blockchain-based copyright management are emerging as critical tools in enforcing copyright. AI-powered systems like YouTube’s Content ID and Facebook’s Rights Manager have enhanced copyright detection, yet they continue to face issues related to fair use misinterpretation and over-enforcement. Blockchain technology, through decentralized copyright registration and smart contracts, offers a promising alternative, though widespread adoption remains a challenge due to legal and scalability concerns. The paper also compares the US and EU approaches to UGC regulation, highlighting the differences between the DMCA’s safe harbor provisions and the EU’s proactive filtering requirements under the Copyright Directive.


As copyright law continues to evolve, the future of UGC regulation will depend on balancing intellectual property protection with digital creativity and user rights. This research emphasizes the need for a collaborative approach involving policymakers, technology companies, and content creators to refine copyright enforcement mechanisms. Greater transparency in automated enforcement, improved dispute resolution, and legal adaptations to emerging technologies will be essential in shaping a fair and effective copyright framework in the digital era.
