ABSTRACT

This study investigates the imperative to criminalize marital rape, analyzing its significance in promoting gender justice and safeguarding human rights. Marital rape, the non-consensual sexual coercion within a marriage, continues to challenge legal and social frameworks worldwide. This research studies about the disparities and the pressing need for comprehensive reform. By reviewing the impacts of criminalizing marital rape in countries that have implemented such legislation, the study examines the enhanced protection it offers to victims, empowering them to seek justice and escape the cycle of abuse. It addresses the misconceptions surrounding marital rape, deconstructing the barriers to acknowledging and prosecuting this form of violence. Also explores cultural, societal, and institutional factors that perpetuate the silence around marital rape, influencing public attitudes and perpetuating gender inequality. By assessing awareness and understanding of marital rape within communities, the study uncovers potential avenues for change through targeted education and public discourse.

This research strives to advance gender equality and human rights by advocating for the criminalization of marital rape. It underscores the urgency of acknowledging and confronting this pervasive form of violence, fostering societal transformation towards a more just and equitable world. By taking concrete steps to criminalize marital rape, societies can establish a framework that respects individual autonomy, consent, and dignity within the institution of marriage, ensuring a safer and more inclusive environment for all.
