Critical Analysis Of Manifestation Of General Data Protection Regulation In Information Technology Act Of 2000 With A Brief Study On Personal Data Protection Bill Of 2018

ABSTRACT


Data is any information which is processed by equipment which create such messages on receiving the appropriate instructions. The internet is a chaotic network of entangled data, encrypted in specific frequencies and bandwidths accessible by devices connected to it. Internet, while being undoubtedly the most recent and arguably greatest invention given to humanity, also comes with a few pitfalls.

Internet has become the home of various different kinds of Commercial activities consisting of B2B, B2C, C2C and C2B activities conducting their businesses in the online ecosystem. This has led to a considerable increase in the traffic involving individuals who find convenience in conducting business, finding consumers and acquiring goods via the Internet. This led to a increased spill of personal data and information of general users into the Internet, making it a massive reservoir of Personal Information of consumers and individuals with presence on the internet, leaving it vulnerable to be abused and misappropriated for pecuniary interests. The General Data Protection Regulation is a global regulation which provides for the rules to be followed for protection of Personal Data and Information and having a secure identity on the Internet. While they regulate the global code of conduct on the Internet, Independent Nations have regulated internet usage in their respective jurisdiction in ways of enaction appropriate legislations domestically.


The Information Technology Act 2000 was introduced in India to address the gap in legislation governing electronic transactions and economic exchanges which were happening on the online Ecosystem.


This paper aims to study the Information Technology Act of 2000 and analyze the provisions, Statutes and Regulations provided under them with regard to Personal Data Protection and Privacy on the Internet. These regulations will be critically analyzed in contrast with the General Data Protection Regulations and highlighting the need for Personal Data Protection Bill for a better regulation for protection of Personal Data on the Internet on India.
