ABSTRACT

The problem of child marriage was rampant in the Indian society. For controlling it the Parliament introduced The Prohibition of Child Marriage 2006 which increased the age for marriage of women to 18 years, but in the recent study it was found that marriages at the age of 18 years would not provide women sufficient opportunity for their mental, physical and educational development which will lead to early pregnancy, maternal death and high dependency on husband. Therefore, The Himanchal Pradesh government presented “The Prohibition of Child Marriage (Himanchal Pradesh Amendment) Bill 2024” which lays down the provision for increasing the age for marriage of women from 18 to 21 years. In this article we will study about the critical analysis of the bill, prevailing Act, need for amendment and its impact on women with references to past case laws and attempts made to crush child marriage.
