Critical Analysis On The Application Of Rule Of Law In India, UK, And US

ABSTRACT


The research paper examines the complexities of constitutional law in the area of administrativelaw, examining its application in India, the United Kingdom and the United States. The basic understanding of A.V. Dicey's three pillars - the supremacy of the law, equality before the lawand the moral authority of the law - serve as a framework for this analysis. In the case of India,the study examines how the Rule of Law (ROL) is incorporated into the constitutional system,with an emphasis on points such as Articles 14 and 21 of Indian Constitution. The study extendsto doctrines such as basic structure and theory of equality, defining the definition. their role insupporting policy and organizational activities. In the context of the United Kingdom, the research describes the early stages of the legal system, emphasizing its foundations in legal tradition, legal convention and modern law. Key pieces of legislation, including the Law Reform Act, 2005 and the Human Rights Act, 1998 are analyzed to reveal their contribution tothe UK regulatory landscape. Similarly, in the United States, the article examines how the ROLmanifests itself in administrative law, focusing on the administrative process. The analysis reveals different approaches to administrative law in these areas, highlighting the mutual agreement on the principles of fairness, transparency and justice. Finally, the study demonstrates the important role of the ROL in administrative law, acting as a pillar to ensure accountability, justice and clarity in the different regimes of law.
