Critical Analysis On The Religious And Socio- Legal Aspects Of Sexual Intercourse With False Pretext Of Marriage

1. ABSTRACT
A key to any healthy relationship is to stay away from deception. A legal and sacred union of two individuals that comes with rights and liabilities towards each other is called marriage. The consent of both individuals involved in a relationship is essential when engaging in sexual activity, whether before or after marriage, but unfortunately, in some cases, women fall prey to the false promises of marriage and engage in a sexual relationship. This research paper focuses on one such concept, where a person seduces another into a sexual relationship under the false pretext of marriage, which assesses the psychological and emotional toll on victims. Cases of sexual activity taking place under the false pretext of marriage are gaining more attention in contemporary society due to their profound implications for individual rights, social norms, and legal justice. The researcher will carefully scrutinise the same, particularly in reference to the sections of the Indian Penal Code. Through this research paper, the researcher focuses on and tries to highlight the ethical, religious, and legal intricacies surrounding such instances. The researcher understands the perspective of major world religions, including Islam, Christianity, and Hinduism, on consensual sexual activity within the context of genuine marital consent. The new bill introduced in Parliament, i.e., the Bharatiya Nyaya Sanhitha Bill, which focuses on crime against women and many social problems faced by them, is also discussed in this paper. This research paper suggests that more stringent laws are required as per the changing trends of society for the better protection of women, rather than making them more vulnerable.
