Critical Appraisal Of The Waqf (Amendment) Bill, 2025

ABSTRACT


The Waqf (Amendment) Bill of 2025 is poised to bring a significant overhaul within the existing legal and administrative framework for the management of waqf properties within India. While ostensibly meant to bring about transparency, accountability, and smooth management of waqf assets, the amendment has sparked off endless rounds of controversies and debates, especially amongst the Muslim community and constitutional lawyers. In this paper, an attempt is made to present a critical analysis of the major provisions of the Bill, the justification for its introduction, as well as the likely repercussions on religious freedom, minority rights, and, seizing upon the opportunity, the secular fabric of India.
