Cybersecurity And Data Protection: Liability And Accountability For AI Cyber Attacks And The Use Of AI in Cybersecurity

ABSTRACT


The intersection of artificial intelligence (AI), cybersecurity, and data protection presents one of the most complex and under-regulated domains in modern law. AI is being increasingly weaponized to carry out cyberattacks, while simultaneously being used as a tool to fortify digital infrastructures. This dual character of AI brings forth significant questions of liability and accountability, especially when AI systems operate autonomously or are deployed negligently. This paper critically examines the legal challenges arising from AI-enabled cyberattacks and the use of AI in cybersecurity, through the lens of existing laws and international frameworks. It further proposes a legal roadmap for resolving accountability concerns in the face of rapidly evolving AI technologies.
