Decriminalization Of Provisions Of The Legal Metrology Act, 2009

Advocate Mala Gangadhara

ABSTRACT

As consumers, we are all aware that every pre-packaged item available for retail sale includes an attested declaration containing information of the product. The declarations include such maximum retail price, the manufacturer's name and address, net quantity, etc. In India, we have a separate legislature that governs the declarations that has to be attested along with a retail pre-packed commodity. The Legal Metrology Act of 2009 and the Legal Metrology (Packaged Commodities) Regulations of 2011 (hence referred to as the "Packaged Commodities Rules") ensures the standards of weights and measures that needs to be adhered by the manufacture/packer/repairer. But the question is how far these laws and Rules demonstrate the ease of doing business and also ensuring that the consumers are not put to.
