Domain Name Related Dispute In IPR In India

ABSTRACT

A Domain Name is a word or a blend of words which assist with recognizing a website's relationship with another person. Domain names are utilized to find a website and are famously known as Uniform Resource Locator (URL). A Domain Name Dispute might emerge when there is encroaching, clashing or potentially unapproved utilization of a domain name on piece of a person. To effectively lay out a Domain Name Dispute, the Complainant is expected to fulfill the rules set down in the different dispute resolution strategies. As the web isn't confined by any borders or limits, and because of the worldwide presence of most organizations, a Domain Name infringement can happen in a country not the same as where it is enrolled. In case of such a trans-border infringement, the individual can utilize the Uniform Domain Name Dispute Resolution Policy (UDRP), a norm and uniform Policy across the world, not at all like homegrown regulations that can change across wards. In the light of this Paper the author has tried to explain the concept of Domain Name Related Dispute and its procedure in India. The Author has briefly explained about the types of domain disputes and their areas of Infringement. Moving ahead with this paper the author has emphasized upon the fact that the Domain names are allowed protection under the umbrella of IPR as per the provisions of the Trademarks Act, 1999. This Paper has been made with an effort to provide readers with a handful information about the domain name related dispute and their regulations under IPR in India.
