Domestic Violence And Judicial Approach In Contemporary India

ABSTRACT


Women in India has been subjected to Domestic Abuse from very long time and even after the coming of legislation in this regard, the incidents of Domestic Violence has not been controlled. This article is an attempt to highlight the issue of domestic violence which is a heated topic of debate from very long time. This study attempted to study the issue of domestic violence from contemporary perspective, as to find out the sudden surge in the cases of domestic violence during the pandemic period. This article has drawn a comparison of Domestic Violence cases from preceding years and presented the picture of current Indian Scenario. This article has also attempted to study the approach of Indian Judiciary on this issue through their Judgements and also depicted the current judicial approach on this Issue. This article has also brought forth the positive points and also criticism on the law of Protection of Women from Domestic Violence Act 2005. This study has shown that how the attitude of Indian Judiciary changed from the past few years from rigid to liberal, through its progressive judgements.
