ABSTRACT
Death is a topic of extreme sensitivity for every human being. As scary as a concept, it is inevitable. With such massive space that the concept of death holds in our heads, when someone is on the verge of dying or even has an apprehension that they are going to die, they are in such a gruesome mental state that all that comes out of their mouths is the sheer truth or statements with extreme veracity in most of the cases.
This is the rationale behind the maxim "Leterm Mortem", which translates to "words spoken before the death," holding heavy significance in the eyes of law when transformed into a legal statement. It is termed as a Dying Declaration.
In some instances, a statement made by a person who is cognizant and aware that death is impending about what they believe to be the cause or circumstances of death may be admissible into evidence during a trial. This article meticulously deals with the intricacies and significance of dying declaration.
