E-Commerce Bias And Preferential Treatment

ABSTRACT


India’s e-commerce industry has contributed to the transformation of retail markets through its optimal consumer choice and ease of use. However, along with this growth and transformation comes the constant worries about bias and preferential treatment in online marketplaces. This study looks into how companies like Amazon and Flipkart are alleged to unfairly benefit from their own affiliated sellers and group businesses through practices like discounts and exclusive agreements. The study shows how these dynamics reinforce one another to marginalise small traders by identifying the practices within the broad legal framework of competition law. The study contends that Myntra’s preferential treatment is a competition law issue with systematic implications for neutrality, market access and long-term consumer welfare in addition to being an FDI concern.
