ABSTRACT
E-governance has emerged as a transformative tool in modern governance, promising enhanced efficiency, transparency, and citizen participation. In India, the adoption of e-governance initiatives has been significant, aiming to improve service delivery and governance processes. However, despite its potential benefits, challenges such as legal ambiguities, inadequate enforcement mechanisms, and cybersecurity vulnerabilities persist, undermining the effective implementation of e-governance. This paper, from the perspective of a law student, examines the role of e-governance in facilitating good governance in India, analyzes existing legal challenges, and advocates for stricter enforcement measures to ensure compliance and accountability.
In India's evolving legal landscape, the integration of e-governance initiatives has necessitated a comprehensive framework to regulate digital interactions between the government, citizens, and other stakeholders. As law students, it is essential to grasp the legal implications of e-governance to assess its role in promoting good governance effectively. This paper delves into the legal intricacies surrounding e-governance in India and underscores the critical need for stricter enforcement to uphold legal principles and ensure effective governance.
The legal framework for e-governance in India comprises a diverse array of statutes, regulations, and guidelines governing digital transactions, data protection, and cybersecurity. Key legislations such as the Information Technology Act, 2000, and the Aadhaar Act, 2016, provide the foundational framework for e-governance initiatives. Additionally, the Right to Information Act, 2005, empowers citizens to access government information, fostering transparency and accountability.
