Ensuring Fair Competition And Innovation In India's E-Commerce Sector: The Role Of Competition Commission Of India (CCI)

ABSTRACT

The e-commerce sector in India has grown rapidly in recent years, and has become a key driver of economic growth and job creation. However, concerns have been raised about the potential impact on competition and consumer welfare, particularly in light of the dominance of a few large players. As the regulator responsible for promoting and maintaining fair competition in India, the Competition Commission of India (CCI) plays a critical role in ensuring that the e-commerce sector operates in a manner that benefits consumers and promotes innovation and growth. This research paper seeks to examine the whether the CCI has been able to strike a balance between ensuring fair competition in India's e-commerce sector while allowing for innovation and growth. The paper explores the key challenges and opportunities in applying competition law to e-commerce, the conceptual framework for balancing competition and innovation, and the policy and regulatory reforms that may be necessary to promote a balanced approach. The research aims to contribute to the ongoing policy debate around e-commerce regulation in India, and provide insights that can inform the development of effective and equitable regulatory frameworks for this critical sector.
