Entrenched Disinclination Towards The Concept Of Adoption And Examining The Effectiveness Of Juvenile Justice (Care And Protection Of Children) Act, 2015

ABSTRACT


In India, there are many statutes dealing with the concept of adoption. Statistics reveal that there are prospective adoptive parents who show their willingness to adopt, yet the adoptions rates are low. The more we dig in to it, the more we realize that adoption is only seen as a last resort when every other means to have a kid fails. Caste, color and gender of the adopted children are still a big fuss in the society. Juvenile Justice (Care and Protection of Children) Act, 2015 is a uniform legislation in which religion does not stand as a wall in adopting children. Even this legislation cannot be said as ideal. Adoption shall be viewed as a child-centric concept rather than parent-centric concept. A law which can deliver justice to the adopted child by providing a safe place to love, learn and grow is much-needed.
