Evaluating Police Accountability Mechanisms Under BNSS, 2023: A Legal And Institutional Perspective

ABSTRACT


The Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023 is a significant change in Indian policing by virtue of its replacement of the Code of Criminal Procedure (CrPC) 1973. This research assesses both the legal

regime and institutional framework through which police accountability is governed in BNSS 2023. The contemporary framework addresses traditional police-related issues regarding detention brutality and illegal arrests alongside abuse of authority through comparison with past legal acts. The evaluation of BNSS, 2023 comprises constitutional analysis alongside judicial reviews and organisational oversight evaluations that expose effective aspects and organisational implementation constraints. The implementation of BNSS 2023 faces challenges from political power and judicial inability to offer oversight and bureaucratic delays despite incorporating progressive features into the framework. The research suggests a strategy for greater transparency and autonomous oversight power development backed by strict accountability mechanisms to safeguard constitutional rights while maintaining legal order.
