ABSTRACT


This paper deals with the concept of the Maintenance of Women after the dissolution of marriages under Muslim Law. This subject matter has been one of the most controversial ones and has undergone many changes over the years The paper highlights the challenges faced by Muslim Women for their fair share of maintenance. The paper has taken special emphasis on all the important case law and legislative constraints in matters of Muslim personal law. Starting from when it was believed that Maintenance for Muslim divorced women is merely a moral duty to the present rule laid down in Daniel latiffi in which the supreme court declared Maintenance for Muslim women a right which cannot be denied. The paper also covers the Critical analysis of all the loopholes used by the society and rationale given by the court while delivering the landmark judgments of Law of Maintenance in India. This paper contains a recommendation for a better way ahead.
