Exploring The Nexus Of Rehabilitation And Punishment: An In-Depth Analysis Of India’s Prison Reform Challenges In The Modern Era

ABSTRACT


This study investigates the complex interplay between punishment and rehabilitation in the evolving Indian criminal justice system. With a focus on the contemporary era, it closely examines the barriers to jail reform, ranging from systemic issues to societal perceptions. An analysis of the impact and efficacy of present prison and rehabilitation programs reveals important areas for improvement, such as community support and infrastructure development. Through an analysis of India's past criminal justice systems, the research provides historical background and illuminates current efforts to strike a balance between punishment and rehabilitation. There are three objectives for this research. First, let's assess the challenges that India's jail reform is now encountering. The evaluation of Indian prison and rehabilitation programs' effects and efficacy, together with suggestions for improvements, constitute the second objective. Finally, a review of India's historical criminal justice systems and current efforts to find a middle ground between imprisonment and rehabilitation. In this paper, a qualitative research methodology is applied. The study explores the challenges of jail reform in India and provides an overview of Indian legislation using interpretative approaches and non-numerical data. The study's results serve as a foundation for deliberate decision-making and ongoing efforts to develop India's criminal justice system to be more effective and humane. They also contribute to a more nuanced comprehension of the associated challenges. It has also provided some best practices and recommendations for raising the caliber and accessibility of rehabilitation programs and ensuring the accountability and transparency of prison management.
