Fairness And Adequacy Of Compensation Under The Right To Fair Compensation And Transparency In Land Acquisition, Rehabilitation And Resettlement (RFCTLARR) Act, 2013

ABSTRACT


The Land Acquisition Act, 1894This was the first major space act during British rule. This act sought to replace the Land Acquisition Act, 1894. This demonstration was tried to be supplanted by the Right to Fair Compensation and Transparency in Land Acquisition of Rehabilitation and Resettlement Act, 2013, which was declared by United Progressive Alliance government after extensive consultations and several rounds of exchange of first legitimate draft prepared in 2011. The Act has without a doubt re-balanced the then imbalance between land-owners and their interests as against that of the Government (which is assumed by law to be custodian of public interest) in case of earlier land acquisition procedures with enhanced compensation for acquired land, social impact assessment as mandatory pre-condition and even permission/consent from eligible majority number of holders of the affected land in some special cases. These research paper examines the procedure for acquisition under the new act and also analyses the aims and objectives of the act. whether the land is being acquired for a public purpose and whether any other land should be acquired for the same purpose. Because the requirements are fairly identical, case laws under the previous act are cited to shed light on some situations. A clause on hearing acquisition-related objections is also included. At end of the research which provide the clear picture of what are the challenges in implementing the new act and impact of the act.
