ABSTRACT

India is a country where every individual can express his or her opinion independently. Our Constitution of India guarantees every citizen freedom of speech and expression under Article 19(1)(a). But it is not an absolute right. The State can impose restrictions under Article 19(2). Our judiciary has interpreted freedom of speech and expression in many ways which include freedom of press, freedom of commercial speech, right to information, right to criticize, right to silence and so on. This paper aims to show the recognition of freedom of speech and expression in the internet era by the interpretation of our Indian judiciary and also the inference of Information Technology Act 2000 in this matter with some landmark cases.

Keywords: Freedom of speech and expression, Cyberspace, Internet, Information Technology Act.
