Karan Solanki, Law College Dehradun

ABSTRACT

We all are aware that in India we have three organs of government i.e.- legislative, executive & judiciary. On the working of these organs of government our country's health, development and overall situation depends and the working of these organs is guided by the constitution of India. As the world is getting complex day by day several issues are arising and are questioning the health of democracy in India. Issues regarding era long rights, law, and policies that should be examined now, as for this our parliament is equipped with the amending power but the delay in action is impacting the citizens and we will try to find out a way forward then we will discuss problems created for others in exercise of right to freedom of speech of expression as we can see the songs are a great source of entertainment but your right should be exercised, in such a way that it don’t harm other person right.

Then problems regarding the mitigating separation of power as in India after the In Re DELHI laws act case it become clear that controlled delegation of power can be there i.e. separation of power can’t be fully achieved as we are growing as a welfare state but in recent times it seen that the controlled transfer of power is not their and the organs are working or interfering in other organs arbitrarily or we can say that they are exceeding their jurisdiction and then we will look upon how the laws needs changes as the society is changing.

In this article we will try to look upon these issues and will try to find a way forward.
